Please read these Terms and Conditions carefully before using our service. By accessing or using our website or services, you agree to be bound by these terms. If you don’t agree, please don’t use the service.
Who We Are
List Now Realty LLC (“we,” “us,” or “our”) is a Florida-licensed flat-fee MLS listing brokerage located at 24818 Turkey Lake Rd, Howey in the Hills, FL 34737. Our website is https://listnowrealty.com/. Matthew J Buttner is our licensed real estate broker (FL License BK3248540).
Acceptance of Terms
By using our website or purchasing our services, you confirm that:
- You are at least 18 years old
- You have the legal authority to enter into this agreement
- You have read and agree to these Terms and our Privacy Policy
If you’re listing a property on behalf of someone else, you must have a valid Power of Attorney or other legally sufficient written authorization from the property owner. You are responsible for ensuring that documentation is valid and current.
Our Services
We are a limited service flat-fee MLS listing brokerage. This means we provide specific services for a flat fee, but we are not a full-service brokerage. It’s important you understand exactly what we do and don’t do before purchasing.
What We Do
- List your property on the local Multiple Listing Service (MLS)
- Syndicate your listing to public real estate websites such as Zillow, Realtor.com, and Homes.com
- Display your listing on our own website at listnowrealty.com
- Provide email-based customer support during business hours
- Update your listing as needed when you submit requested changes
- Provide guidance on MLS rules and compliance
- Optionally set up ShowingTime for your listing if requested
What We Don’t Do
- Provide full-service brokerage representation
- Host or attend open houses
- Show your property to buyers
- Provide pricing recommendations or comparative market analyses as a standard service
- Negotiate with buyers or buyer agents on your behalf
- Provide phone-based customer support (all communication is via email)
- List rental properties
- Offer legal, tax, or financial advice
Communication Policy
All customer service is handled by email. This allows us to keep accurate records of every request and respond efficiently. We do not provide phone support for service-related matters. Our business hours are 9 AM to 5 PM Eastern, Monday through Friday.
Coverage Area
We serve specific Florida counties only. A current list of counties we cover is available on our contact page. We do not list properties outside of our coverage area.
No Guarantees
We commit to doing the best job possible for our clients, but we do not guarantee:
- That your property will sell
- Any specific timeline for sale
- Any specific number of leads, calls, or showings
- Any specific sale price
- How third-party websites will display or syndicate your listing
Your Responsibilities
When you use our service, you agree to:
- Provide accurate, complete, and current information about yourself and your property
- Submit only photos and content that you own or have the legal right to use
- Comply with all applicable MLS rules and regulations
- Respond promptly to requests for information or documentation needed to complete or maintain your listing
- Handle showings, negotiations, and contract discussions directly with buyers and buyer agents
- Keep your contact information up to date
- Notify us promptly of any changes to your listing or its status
MLS Rules and Compliance
Your listing must comply with all rules of the local MLS, including rules about photo content, listing remarks, and prohibited language. We may decline to upload content that violates MLS rules or modify listings to bring them into compliance. Common examples of non-compliant content include photos with text overlays, watermarks from other listings, contact information in public remarks, and references to buyer agent compensation.
If the MLS issues a fine due to content you submitted (for example, photos you did not own the rights to), you are responsible for paying that fine.
Buyer Agent Compensation
Due to the 2024 NAR settlement, offers of buyer agent compensation cannot be included in MLS listings or any related public marketing materials. You are free to negotiate compensation directly with buyer agents on a case-by-case basis when they contact you about your property.
Payments
All services are paid for at the time of purchase. We accept major credit and debit cards, including Visa, MasterCard, American Express, and Discover, as well as online payment methods. Payment is processed by our third-party payment processor (Stripe), and we do not store your card details.
Your payment is subject to validation and authorization by your card issuer. If we don’t receive authorization, we may not be able to process your order.
Cancellations and Refunds
You may cancel your service at any time by sending us an email. There is no cancellation fee.
Refund eligibility depends on whether your listing has been published to the MLS and how much time has passed since your purchase. Full details are available on our Refund Policy page, which is incorporated into these Terms by reference.
Pricing
We reserve the right to change our pricing at any time before accepting your order. Once we accept your order, the agreed price will not change.
Your Content
Ownership and License
You retain ownership of all content you submit to us, including photos, descriptions, and other listing materials. By submitting content, you grant us a license to use, display, modify, reproduce, and distribute that content as needed to provide our services. This includes submitting your content to the MLS, syndication partners, and our own website.
Your Warranties
By submitting content, you confirm that:
- You own the content or have permission to use it
- Your content does not violate anyone else’s rights, including copyrights, privacy rights, or contract rights
- The information you provide is accurate and not misleading
Prohibited Content
You may not submit content that is:
- Unlawful, threatening, defamatory, or obscene
- Discriminatory or harassing
- Designed to defraud or mislead
- Spam or unauthorized advertising
- Infringing on someone else’s intellectual property
- Containing viruses or other harmful code
- Impersonating another person or entity
We reserve the right to refuse, remove, or modify any content that violates these terms or MLS rules.
Content Backups
While we maintain regular backups, we don’t guarantee that no data loss will occur. We recommend you keep your own copies of any content you submit to us.
Intellectual Property
Our website, branding, and original content are owned by List Now Realty LLC and protected by copyright, trademark, and other laws. You may not use our trademarks or branding without our written permission.
Copyright Infringement (DMCA)
We respect intellectual property rights. If you believe content on our service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to info@listnowrealty.com. Your notice must include:
- Your physical or electronic signature
- A description of the copyrighted work you claim has been infringed
- The location (URL or other identification) of the allegedly infringing material
- Your contact information (address, phone, email)
- A statement that you have a good faith belief the use is not authorized
- A statement, made under penalty of perjury, that your information is accurate and you are the copyright owner or authorized to act on their behalf
Submitting a false DMCA notice may result in legal liability for damages, including costs and attorney’s fees.
Feedback
If you send us feedback or suggestions about our service, you grant us the right to use that feedback freely without any obligation to you.
Termination
We may suspend or terminate your access to our service at any time, without notice, if you violate these Terms. Upon termination, your right to use the service ends immediately. Termination does not affect any obligations that already exist between us, such as outstanding payments owed.
Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or our services is limited to the amount you actually paid us, or $100 USD if you haven’t paid us anything.
We will not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost data, or business interruption, even if we knew such damages were possible.
Some states don’t allow these limitations, so they may not apply to you. In those cases, our liability will be limited to the greatest extent permitted by law.
“As Is” Disclaimer
Our service is provided “as is” and “as available” without any warranties of any kind, whether express or implied. We don’t guarantee that the service will meet your needs, be uninterrupted, be error-free, or be free of viruses or other harmful components.
We do not warrant the accuracy, reliability, or timeliness of any information provided through the service. Information from the MLS, third-party real estate websites, and other sources is subject to change without notice.
Links to Other Websites
Our service may contain links to third-party websites we don’t control. We are not responsible for the content, privacy practices, or terms of those websites. We encourage you to review the terms and privacy policies of any third-party site you visit.
Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules.
If you have a dispute with us, please first contact us to try to resolve it informally. If we can’t resolve the dispute, any legal action must be filed in the state or federal courts located in Lake County, Florida. By using our service, you agree to the exclusive jurisdiction of these courts.
U.S. Legal Compliance
By using our service, you confirm that you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties.
Severability
If any part of these Terms is found to be unenforceable, the rest of the Terms will remain in full effect. The unenforceable part will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
Waiver
If we don’t enforce a right or provision of these Terms, that doesn’t mean we’ve waived our right to enforce it later.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we’ll provide reasonable notice, typically at least 30 days before the new terms take effect. By continuing to use our service after changes take effect, you agree to the updated Terms. If you don’t agree, please stop using the service.
Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, make up the entire agreement between you and List Now Realty LLC regarding our services.
